Terms and Conditions
We provide a rotating schedule of meals each week with various optional meals available to choose from. For details on ingredients, meals schedule, meal options and delivery areas, please see our website for specific details. The meal types that you will receive each week, as well as the number of meals and serving portion size will depend on the Subscription Plan that you have chosen. By default the Meal items you receive will be automatically chosen with our automatically rotating meal schedule, however if you would like to deviate from the schedule you can choose from the available meal options for that week. Your meal options will be provided to you by an online Questionnaire emailed to you prior to the next delivery period. If you do not make any changes to your Meal items via the online Questionnaire, then you will automatically receive the standard meal rotating schedule called “Chef’s Selection”. Depending on the details of your Subscription choice and whether a promotional offer applies, your price of your Subscription Plan may change. Unfortunately, Subscription Plans are not available everywhere. You can only subscribe if you live in one of our delivery areas. Please see our website for an up to data description of active delivery areas that we are surviving. We reserve the right to decline to deliver Meal Orders to any address at our sole discretion.
Meal deliveries occur near the beginning of the week, typically Monday or Tuesday depending on where in the delivery area you are located. Standard subscriptions provide 4 weeks of meals per month. Over the calendar year there may be several months where the weeks fall in odd times, essentially creating an extra week in the month.
COOLER BAGS AND CONDIMENT KITS
Meals orders are delivered in a reusable Cooler bag, as well as with reusable condiment bags and containers. We request that after delivery and after Condiment Bags and containers are empty that you make them available to be returned to MANNA Meals. In most situations it would be best to leave out for retrieval by us on the day of delivery of your weekly Meal Order. If you have cancelled, paused your Subscription, or if your account has been deleted, we require reasonable cooperation with the retrieval of any Cooler Bags or Condiment Kits. At all times, the Cooler Bags and Condiment Kits will remain the property of MANNA Meals. We reserve the right to charge you the cost of the Cooler Bags and Condiment Kits if we are unable to retrieve them after three attempts.
When you sign up for one of our Meal Subscription Plans, it is a recurring subscription that auto-renews successively unless cancelled in accordance with these Terms. This means that you will be charged an initial fee and then thereafter on a recurring basis for your Subscription Plan. Having an active subscription means you authorize us (or our third-party payment processor) to charge your payment method the initial fee and then on an recurring basis for your Subscription Plan, unless you have set your subscription status to be “paused”.
To cancel your Subscription Plan, please email email@example.com with your cancellation request. However, you will still be obligated to pay for any Meal Orders that have been processed after the 7 day cut off period prior to upcoming next week's delivery.
The products contained in your Meal Orders are for personal use only, they are not for resale or commercial use.
The ingredients in your Meal Orders are meant to be prepared and eaten with 7 days of delivery. Each Meal Order item typically has an expiration date label applied to remind and inform you of the expiration date. You agree not to consume or allow any other person to consume any Meal Order items that have passed the expiration date period.
It is safe to freeze most of the Meal Order items to eat at a later date. You will find a Freeze Friendly label on each individual item to determine if it is Freezable.
We agree to supply and deliver the products you order from us to be delivered to the delivery address (the ‘Delivery Address’) recorded in your Account either by us or one of our Affiliates (such person making the delivery, the ‘Courier”). You are responsible for ensuring that delivery at the Delivery Address is safe for the Courier.
Our Cooler Bags are intended to keep Meal Orders cool for up to 2 hours, depending on weather, ambient outdoor temperature and exposure to direct sunlight, therefore some food may spoil quicker than anticipated. If you know that you cannot immediately receive your Meal Delivery Order from us, we recommend that you arrange alternate plans for faster refrigeration of your meals.
If something in your Meal Order is delivered damaged, spoiled or missing, please take a photo and email us at firstname.lastname@example.org.
You are responsible for ensuring that your Meal Order is safe for consumption. This means checking the contents of any delivery to confirm no items are spoiled or damaged, and that perishable food/beverage items are promptly refrigerated and stored at safe temperature (below 4°C), as well as food items that require heating are heated above safe temperature (above 74°C) and follow food safety and handling guidelines. PAYMENT AND ADDITIONAL CHARGES
When you provide a payment method, such as a credit card, that is accepted by us, you represent and warrant that you are authorized to use such a payment method and that you authorize us (or our third-party payment processor) to charge your payment method for all applicable Charges. If we or our third-party payment processor are unable to verify your payment method, or if it is otherwise invalid or not acceptable, we may suspend or cancel your order.
You acknowledge and agree that your use and purchase of our products may result in Additional Charges to you. Additional Charges may include applicable taxes, shipping and handling fees, as well as Condiments Kits and unreturned reusable delivery/packaging items. Additional charges may be one-time or recurring, depending on what you have purchased.
All purchases of Products and Services are final, except as otherwise provided in these Terms, non-refundable and non-returnable, including, without limitation, Subscription Plans and Non-Subscription Products and Services. Subject to (a) the terms applicable to your selected payment processing method, and (b) applicable law, you are solely responsible for any unauthorized, fraudulent, or erroneous transactions related to your use of our website and/or your receipt of the Services.
Prices shown on the website are in Canadian Dollars (CAD) unless otherwise noted. Pricing and availability is subject to change without notice.
If for any reason you are not satisfied with your meal then please email us immediately at email@example.com and let us know which meal you were not happy with and why. Upon receipt we will email you a gift certificate for value of that meal on your order with 5 business days. Note: you must submit your satisfaction request within the expiry date listed on your meal package (typ. 5-7 days from delivery date of meals).
Contrary to these terms, we may impose a limit on the purchasable quantity of a particular product or service.
Delivery of products and services is subject to availability. If you have paid for a product but it is unavailable, we will notify you of the unavailability and either refund you the purchase value, or prorate the refund proportional to the percentage of the product, service or subscription that is unavailable. We may also be in a position to offer you a replacement product or service of equal or greater value.

NEITHER MANNA MENU NOR THE AFFILIATES, RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS OR SERVICE PROVIDERS WARRANT THAT THE SERVICES WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED OR, THAT OUR WEBSITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
YOU DECLARE THAT YOUR ARE AWARE OF THE RISKS, DANGERS, AND HAZARDS ASSOCIATED WITH WASHING, HANDLING, PREPARING, COOKING, STORING, DISPOSING, AND CONSUMING FOOD AND BEVERAGES.
WITHOUT LIMITATION ANYTHING ELSE IN THESE TERMS, WE EXPRESSLY WARN YOU THAT SOME OF OUR PRODUCTS CONTAIN ALLERGENS AND THAT CROSS-CONTAMINATION OF ALLERGENS MAY OCCUR BETWEEN OUR PRODUCTS EVEN IF A GIVEN PRODUCT DOES NOT HAVE AN ALLERGEN ON ITS INGREDIENT LIST. YOU ASSUME ALL RISK RELATED TO ALLERGENS AND RELEASE US OF THE SAME.
WITHOUT LIMITING THESE TERMS TO THE EXTENT PERMITTED BY LAW, MANNA MENU, THE AFFILIATES AND RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS OR SERVICE PROVIDERS ASSIGNS CUMULATIVE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US (OR IF YOU USED THE SERVICES ON A FREE BASIS, THEN OUR LIABILITY WILL NOT EXCEED $1.00 CAD).
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD MANNA MENU, THE AFFILIATES, RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS OR SERVICE PROVIDERS AGAINST THIRD-PARTY CLAIMS, LIABILITY, DAMAGES, JUDGMENTS, AWARDS, LOSSES, COSTS, EXPENSES, OR FEES (INCLUDING REASONABLE ATTORNEY’S FEES) ARISING OUT OF OR RELATING TO YOUR BREACH OF THESE TERMS, YOUR USE, ACCESS OR RECEIPT OF THE PRODUCTS OR SERVICES, OR ANY ACTS YOU TAKE OR FAIL TO TAKE. YOU AGREE THAT IF ANY OF THE FOREGOING INDEMNIFIED PARTIES ARE THE DEFENDANT, RECIPIENT OR TARGET OF A CLAIM, SUCH INDEMNIFIED PARTY MAY TAKE EXCLUSIVE CONTROL OR THE DEFENSE OR SETTLEMENT OF SUCH CLAIM MADE AGAINST THEM.
We may terminate these Terms, or any of the Services, without providing you notice.
WAIVER OF CLASS ACTION
You hereby agree to waive any rights you may have to commence or participate in any class action against MANNA Menu, or either of their respective directors, officers, employees, agents, service providers, contractors, licensors, suppliers, subsidiaries, successors, and assigns related to any claim and, where applicable, you also agree to opt out of any class proceedings again MANNA Menu or its Affiliates.
